Please review these policies carefully as they are the terms of sale that govern your purchases at the JC Computers Store.
They set out your rights and obligations with respect to your purchases, including important limitations and exclusions, such as those JC Computers product warranties.
Your placement of an order at the JC Computers constitutes your agreement that these policies apply to the order, so be certain you understand them before you place your order.
Please note there may be limitations on your right to return and obtain a refund for products.

CONSUMER RIGHTS AND RESTRICTIONS
FOR CONSUMERS, WHO ARE COVERED BY CONSUMER PROTECTION LAWS OR REGULATIONS IN THEIR COUNTRY OF PURCHASE OR, IF DIFFERENT, THEIR COUNTRY OF RESIDENCE, THE BENEFITS CONFERRED BY THIS WARRANTY ARE IN ADDITION TO ALL RIGHTS AND REMEDIES CONVEYED BY SUCH CONSUMER PROTECTION LAWS AND REGULATIONS.
THIS WARRANTY DOES NOT EXCLUDE, LIMIT OR SUSPEND ANY RIGHTS OF CONSUMERS ARISING OUT OF NON-CONFORMITY WITH A SALES CONTRACT.
HOWEVER, AS DESCRIBED BELOW, JC COMPUTERS DISCLAIMS STATUTORY AND IMPLIED WARRANTIES TO THE EXTENT PERMITTED BY LAW, AND IN SO FAR AS SUCH WARRANTIES CANNOT BE DISCLAIMED, ALL SUCH WARRANTIES SHALL TO THE EXTENT PERMITTED BY LAW BE LIMITED IN DURATION TO THE DURATION OF THE EXPRESS WARRANTY DESCRIBED BELOW AND TO THE REPAIR OR REPLACEMENT SERVICE AS DETERMINED BY JC COMPUTERS IN ITS SOLE DISCRETION.
SOME STATES (COUNTRIES AND PROVINCES) DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY OR CONDITION MAY LAST, SO THE LIMITATIONS DESCRIBED ABOVE MAY NOT APPLY TO YOU.
THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROMSTATE TO STATE (OR BY COUNTRY OR PROVINCE).
THIS LIMITED WARRANTY IS GOVERNED BY AND CONSTRUED UNDER THE LAWS OF THE COUNTRY IN WHICH THE PRODUCT PURCHASE TOOK PLACE.
JC COMPUTERS, THE WARRANTOR UNDER THIS LIMITED WARRANTY, IS IDENTIFIED AT THE END OF THIS DOCUMENT ACCORDING TO THE COUNTRY OR REGION IN WHICH THE
PRODUCT PURCHASE TOOK PLACE.
WARRANTY
JC COMPUTERS warranty obligations for this hardware product are limited to the terms set forth herein.
JC COMPUTERS, as defined in the table below, warrants this JC COMPUTERS-branded hardware product against defects in materials and workmanship under normal use for a period of ONE (1) YEAR from the date of retail purchase by the original end-user purchaser (“Warranty Period”).
If a hardware defect arises and a valid claim is received within the Warranty Period, at its option and to the extent permitted by law, JC COMPUTERS will either:
(1) repair the hardware defect at no charge, using new or refurbished parts that are equivalent to new in performance and reliability,
(2) exchange the product with a product that is new or refurbished that is equivalent to new in performance and reliability and is at least functionally equivalent to the original product, or
(3) provide a credit for the price of the product.
JC COMPUTERS may request that you replace defective parts with user-installable new or refurbished parts that JC COMPUTERS provides in fulfillment of its warranty obligation. A replacement product or part, including a user-installable part that has been installed in accordance with instructions provided by JC COMPUTERS, assumes the remaining warranty of the original product or ninety (90) days from the date of replacement or repair, whichever provides longer coverage for you.
When a product or part is exchanged, any replacement item becomes your property and the replaced item becomes JC COMPUTERS’s property.
Parts provided by JC COMPUTERS in fulfillment of its warranty obligation must be used in products for which warranty service is claimed. When a refund is given, the product for which the refund is provided must be returned to JC COMPUTERS and becomes JC COMPUTERS’s property.
EXCLUSIONS AND LIMITATIONS
TO THE EXTENT PERMITTED BY LAW, THIS WARRANTY AND THE REMEDIES SET FORTH ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL, WRITTEN, STATUTORY, EXPRESS OR IMPLIED.
AS PERMITTED BY APPLICABLE LAW, JC COMPUTERS SPECIFICALLY DISCLAIMS ANY AND ALL STATUTORY OR IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND WARRANTIES AGAINST HIDDEN OR LATENT DEFECTS.
IF JC COMPUTERS CANNOT LAWFULLY DISCLAIM STATUTORY OR IMPLIED WARRANTIES THEN TO THE EXTENT PERMITTED BY LAW, ALL SUCH WARRANTIES SHALL BE LIMITED IN DURATION TO THE DURATION OF THE EXPRESS WARRANTY AND TO THE REPAIR OR REPLACEMENT SERVICE AS DETERMINED BY JC COMPUTERS IN ITS SOLE DISCRETION.

No JC COMPUTERS reseller, agent, or employee is authorized to make any modification, extension, or addition to this warranty. If any term is held to be illegal or unenforceable, the legality or enforceability of the remaining terms shall not be affected or impaired.
This Limited Warranty applies only to hardware products manufactured by or for JC COMPUTERS that can be identified by the “JC COMPUTERS” trademark, trade name, or logo affixed to them. The Limited Warranty does not apply to any non-JC COMPUTERS hardware products or any software, even if packaged or sold with JC COMPUTERS hardware.
Manufacturers, suppliers, or publishers, other than JC COMPUTERS, may provide their own warranties to the end user purchaser, but JC COMPUTERS, in so far as permitted by law, provides their products “as is”.
Software distributed by JC COMPUTERS with or without the JC COMPUTERS brand name (including, but not limited to system software) is not covered under this Limited Warranty.
Refer to the licensing agreement accompanying the software for details of your rights with respect to its use.
JC COMPUTERS does not warrant that the operation of the product will be uninterrupted or error-free.
JC COMPUTERS is not responsible for damage arising from failure to follow instructions relating to the product’s use.
This warranty does not apply: (a) to consumable parts, such as batteries, unless damage has occurred due to a defect in materials or workmanship; (b) to cosmetic damage, including but not limited to scratches, dents and broken plastic on ports; (c) to damage caused by use with non-JC COMPUTERS products; (d) to damage caused by accident, abuse, misuse, liquid contact, fire, earthquake or other external causes; (e) to damage caused by operating the product outside the permitted or intended uses described by JC COMPUTERS; (f) to damage caused by service (including upgrades and expansions) performed by anyone who is not a representative of JC COMPUTERS or an JC COMPUTERS Authorized Service Provider (“JASP”); (g) to a product or part that has been modified to alter functionality or capability without the written permission of JC COMPUTERS; (h) to defects caused by normal wear and tear or otherwise due to the normal aging of the product or (i) if any JC COMPUTERS serial number has been removed or defaced.
EXCEPT AS PROVIDED IN THIS WARRANTY AND TO THE EXTENT PERMITTED BY LAW, JC COMPUTERS IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, INCLUDING BUT NOT LIMITED TO LOSS OF USE; LOSS OF REVENUE; LOSS OF ACTUAL OR ANTICIPATED PROFITS (INCLUDING LOSS OF PROFITS ON CONTRACTS); LOSS OF THE USE OF MONEY; LOSS OF ANTICIPATED SAVINGS; LOSS OF BUSINESS; LOSS OF
OPPORTUNITY; LOSS OF GOODWILL; LOSS OF REPUTATION; LOSS OF, DAMAGE TO, COMPROMISE OR CORRUPTION OF DATA; OR ANY INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE HOWSOEVER CAUSED INCLUDING THE REPLACEMENT OF EQUIPMENT AND PROPERTY, ANY COSTS OF RECOVERING, PROGRAMMING, OR REPRODUCING ANY PROGRAM OR DATA STORED OR USED WITH JC COMPUTERS PRODUCTS AND ANY FAILURE TO MAINTAIN THE CONFIDENTIALITY OF DATA STORED ON THE PRODUCT.
THE FOREGOING LIMITATION SHALL NOT APPLY TO DEATH OR PERSONAL INJURY CLAIMS, OR ANY STATUTORY LIABILITY FOR INTENTIONAL AND GROSS NEGLIGENT ACTS AND/OR OMISSIONS.
JC COMPUTERS DISCLAIMS ANY REPRESENTATION THAT IT WILL BE ABLE TO REPAIR ANY PRODUCT UNDER THIS WARRANTY OR MAKE A PRODUCT EXCHANGE WITHOUT RISK TO OR LOSS OF THE PROGRAMS OR DATA.
SOME STATES (COUNTRIES AND PROVINCES) DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
OBTAINING WARRANTY SERVICE
JC COMPUTERS will provide warranty service (i) at a JC COMPUTERS Retail, where service is performed at the location, or the JC COMPUTERS Retail may send the product to a JC COMPUTERS repair service location for service, (ii) by sending you prepaid way bills (and if you no longer have the original packaging, JC COMPUTERS may send you packaging material) to enable you to ship the product to JC COMPUTERS’s repair service location for service, or (iii) by sending you customer installable new or refurbished replacement product or parts to enable you to service or exchange your own product (“DIY Service”).
Upon receipt of the replacement product or part, the original product or part becomes the property of JC COMPUTERS and you agree to follow instructions, including, if required, arranging the return of original product or part to JC COMPUTERS in a timely manner.
When providing DIY Service requiring the return of the original product or part, JC COMPUTERS may require a credit card authorization as security for the retail price of the replacement product or part and applicable shipping costs.
If you follow instructions, JC COMPUTERS will cancel the credit card authorization, so you will not be charged for the product or part and shipping costs.
If you fail to return the replaced product or part as instructed or the replaced product or part is not eligible for warranty service, JC COMPUTERS will charge the credit card for the authorized amount.
If the product is still not functioning properly after making use of these resources, please contact the JC COMPUTERS representatives or, if applicable, an JC COMPUTERS owned retail store (“JC COMPUTERS Retail”) using the information provided below.
When contacting JC COMPUTERS via telephone, other charges may apply depending on your location.
When calling, an JC COMPUTERS representative or JASP will help determine whether your product requires service and, if it does, will inform you how JC COMPUTERS will provide it.
You must assist in diagnosing issues with your product and follow JC COMPUTERS’s warranty processes.
Service options, parts availability and response times may vary according to the country in which service is requested. Service options are subject to change at any time. You may be responsible for shipping and handling charges if the product cannot be serviced in the country in which service is requested.
If you seek service in a country that is not the country of purchase, you will comply with all applicable import and export laws and regulations and be responsible for all custom duties, V.A.T. and other associated taxes and charges.
For international service, JC COMPUTERS may repair or exchange defective products and parts with comparable products and parts that comply with local standards.
In accordance with applicable law, JC COMPUTERS may require that you furnish proof of purchase details and/or comply with registration requirements before receiving warranty service.
PRIVACY
JC COMPUTERS will maintain and use customer information in accordance with the JC COMPUTERS Customer Privacy Policy available here
DATA BACKUP
If your product is capable of storing software programs, data and other information, you should make periodic backup copies of the information contained on the product’s hard drive or other storage media to protect the contents and as a precaution against possible operational failures.
Before you deliver your product for warranty service it is your responsibility to keep a separate backup copy of the contents, remove all personal information and that you want to protect and disable any security passwords.
IT IS POSSIBLE THAT THE CONTENTS OF YOUR HARD DRIVE WILL BE LOST OR REFORMATTED IN THE COURSE OF WARRANTY SERVICE, AND JC COMPUTERS AND ITS AGENTS ARE NOT RESPONSIBLE FOR ANY DAMAGE TO OR LOSS OF PROGRAMS, DATA OR OTHER INFORMATION CONTAINED ON THE MEDIA OR ANY PART OF THE PRODUCT SERVICED.
Your product or a replacement product will be returned to you configured as your product was when originally purchased, subject to applicable updates.
You will be responsible for reinstalling all other software programs, data and passwords. Recovery and reinstallation of software programs and user data are not covered under this Limited Warranty.
Non-JC COMPUTERS Branded/Third-Party Products
If you discover what you believe is a product defect for any third-party product, please contact the manufacturer of such third-party product directly for information regarding the manufacturer's warranty.
Please note that products sold through the JC COMPUTERS Store that do not bear the JC COMPUTERS brand name are serviced and supported exclusively by their manufacturers in accordance with the terms and conditions packaged with the products.
JC COMPUTERS's Limited Warranty does not apply to products that are not JC COMPUTERS-branded, even if packaged or sold with JC COMPUTERS products.

If you discover what you believe is a product defect for any JC COMPUTERS-branded product, please contact JC COMPUTERS.
If your product does have a defect, your product is covered under the terms of your product's warranty.
Please refer to the warranty information and other supporting documentation that came with your product.

Other Terms and Conditions
JC COMPUTERS is not responsible for typographical errors.
JC COMPUTERS reserves the right to cancel any order you have placed if there was a typographical error on the JC COMPUTERS Store concerning the pricing or availability of any item you ordered when you placed the order.
JC COMPUTERS reserves the right to change the terms and conditions of sale at the JC COMPUTERS Store at any time.
JC COMPUTERS may make changes to any products or services offered at the JC COMPUTERS Store, or to the applicable prices for any such products or services, at any time, without notice.
The information provided at the JC COMPUTERS Store with respect to products and services may be out of date, and JC COMPUTERS makes no commitment to update the information provided at the JC COMPUTERS Store with respect to such products and services.
JC COMPUTERS reserves the right to do any of the following, at any time, without notice:
(1) to modify, suspend or terminate operation of or access to the JC COMPUTERS Store, or to any portion of the JC COMPUTERS Store, for any reason;
(2) to modify or change the JC COMPUTERS Store, or any portion of the JC COMPUTERS Store, and any applicable policies or terms; and
(3) to interrupt the operation of the JC COMPUTERS Store, or any portion of the JC COMPUTERS Store, as necessary to perform routine or non-routine maintenance, error correction, or other changes.
To the extent permitted by law, all sales at the JC COMPUTERS Store are governed by Canadian law, without giving effect to its conflict of law provisions.
No JC COMPUTERS employee or agent has the authority to vary any of the JC COMPUTERS Store's policies or the terms and conditions governing any sale.
If any of the aforementioned policies are held by a court or other tribunal of competent jurisdiction to be void or unenforceable, such policy shall be limited or eliminated to the minimum extent necessary and replaced with a valid provision that best embodies the intent of the policy, so that the policies shall remain in full force and effect.
JC COMPUTERS’s failure to insist on or enforce strict performance of these policies shall not be construed as a waiver by JC COMPUTERS of any provision or any right it has to enforce these policies, nor shall any course of conduct between JC COMPUTERS and you or any other party be deemed to modify any provision of these policies.
These policies shall not be interpreted or construed to confer any rights or remedies on any third parties.
The JC COMPUTERS Store provides access to JC COMPUTERS international data and, therefore, may contain references or cross references to JC COMPUTERS products, programs and services that are not announced in your country.
Such reference does not imply that JC COMPUTERS in your country intends to announce such products, programs or services.
Prices
The JC COMPUTERS Store endeavors to offer you competitive prices on current JC COMPUTERS products, selected Sale and JC COMPUTERS Certified Reconditioned products, and third-party products.
Your total order price will include the price of the product on the day of shipping plus any shipping charges.
JC COMPUTERS reserves the right to change prices for products displayed at the JC COMPUTERS Store at any time and particularly to correct pricing errors that appear in the Store.
Should JC COMPUTERS reduce its price on any shipped product within 14 calendar days of shipment, you may contact JC COMPUTERS to request a refund or credit of the difference between the price you were charged and the current selling price.
To receive the refund or credit you must contact JC COMPUTERS within 14 calendar days of the price change.
Order Processing
The estimated shipment date on your order is based on product availability, payment processing time, and warehouse processing time and does not include transit time.
JC COMPUTERS does not begin payment processing until JC COMPUTERS receives all of the information that it needs and full payment or a full authorization, in the case of credit card, Visa card, and lease orders.
JC COMPUTERS will begin payment processing for orders placed on weekends or holidays on the next business day. Business days are Monday through Friday, excluding federal holidays.
Your order for in-stock items that are eligible for same-day shipping must be received before your local time of 2:00 p.m., pending payment processing, for there to be adequate remaining time in the day for your order to be dispatched.
JC COMPUTERS ships some products from locations outside the United States.
Next Business Day shipping is not available on products shipped from outside the United States.

Product Availability
JC COMPUTERS makes every effort to ship your product according to the estimated lead times provided by the JC COMPUTERS Store at checkout.
The estimated lead times are in business days (Monday through Friday, excluding federal holidays).
Lead times quoted on the checkout page are for orders that are partially shipped, meaning that items ship as soon as they are available.
If you have requested a complete shipment, please add three to four additional days for transportation and order consolidation processing.
Although JC COMPUTERS makes every effort to ship your order according to the lead time provided, shipping dates may change due to changes in supply.
If the lead time changes, JC COMPUTERS will contact you via email and provide a revised shipping estimate.
Given the popularity of some products, JC COMPUTERS may restrict the number of such items that you may purchase.
JC COMPUTERS will post limitations on quantity on the JC COMPUTERS Store website or will inform you of product purchase limits at the time it processes your order.
JC COMPUTERS reserves the right to change quantities available for purchase at any time.
JC COMPUTERS makes every effort to supply you with the products you order, but there may be occasions when JC COMPUTERS confirms orders but learns that it cannot supply the ordered products, either at all or in the quantities ordered.
These occasions can include when JC COMPUTERS learns that the products no longer are being manufactured or they otherwise become unavailable to JC COMPUTERS, when JC COMPUTERS cannot source components for the configuration you ordered, or when there was a pricing error at the JC COMPUTERS Store when you ordered.
In those circumstances, JC COMPUTERS will contact you to inform you and, if you are interested, JC COMPUTERS may suggest alternative products that might meet your needs. If you do not wish to order alternative products, JC COMPUTERS will cancel your order for products JC COMPUTERS cannot supply and for any other products that you no longer wish to order as a result, and will refund your purchase price for those products.
